ELK RIVER DVD CLUB

As a member of the Elk River DVD Club you will be privy to many benefits and specials as they become available. You can take out two DVD’s at a time, for as long as you want, as many as you want a month, for a flat rate of $20.00 per month. No due dates, no late fees, ever! We do ask that New Releases be returned within a week in order for others to view them while they are still New Releases.

Once you are signed up, pick out two movies and take them home. Keep them as long as you want since there are no due dates or late fees. When you return a movie, you can take another in its place (up to 2 in your possession at any one time).

TERMS OF USE

Acceptance of Terms of Use
These Terms of Use govern your use of the Elk River DVD Club. By using the Elk River DVD Club, you accept and agree to be bound by these Terms of Use. If you do not agree to these Terms of Use, you should not join the Elk River DVD Club.

Privacy
Any information submitted on the Elk River DVD Club application is subject to our Privacy Policy, the terms of which are incorporated herein. Please review our Privacy Policy to understand our practices.

Membership and Billing
You can review the specific details regarding your membership with Elk River DVD Club at anytime during regular business hours.

*Billing*
As a member of Elk River DVD Club, you agree that we are permitted to charge your credit card or debit card a monthly membership fee and any other charges you may incur in connection with your use of Elk River DVD Club. The membership fee will be billed at the beginning of your membership and on each monthly renewal thereafter unless and until you cancel. We will automatically charge your credit card each month on the calendar day corresponding to the commencement of your membership. In the event your membership began on a day not contained in a given month, we will bill your credit card on the last day of such month. For example, if you became a member on January 31st, your card would be billed on February 28th. All fees and charges are nonrefundable. We may change the fees and charges in effect, or add new fees and charges from time to time, but we will give you advance notice of these changes by mail. If you want to use a different credit card or if there is a change in your credit card validity or expiration date, you will need to inform Elk River DVD Club management at least one week in advance of your billing date in order for the information to be processed and updated before that monthly scheduled billing date.

*Automatic Renewals*
Your Elk River DVD Club membership will be automatically renewed on a monthly basis. For your convenience, we will charge the monthly membership fee to the credit/debit card you provide to us during registration (or to a different credit card if you change your account information). Your membership will automatically renew for successive monthly membership without prior notice to you, unless and until you cancel your membership or we terminate it. You must cancel your membership before it renews in order to avoid billing of membership fees to your credit/debit card.

*Cancellation*
As noted above, you may cancel your membership to Elk River DVD Club at anytime. To cancel, contact Elk River DVD Club management prior to your scheduled billing date. We do not provide refunds or credits for any partial monthly membership periods. Upon cancellation, you will be given seven (7) days to return any outstanding movies and DVD case. Failure to return such movies will result in your credit/debit card being billed for such items.

Account Access
In order to provide you with ease of access to your account, Elk River DVD Club will issue you a DVD case with your name and the account number that identifies your account in the system. At registration, the “responsible party” may designate additional family members that will be allowed to check-out movies on that account. That information will be kept on file. Your Elk River DVD Club case will enable us to recognize you as a member and thus provide you with access to your account information. You are responsible for maintaining your account and restricting usage to yourself and/or selected family members. If we find that this usage is being abused (allowing others to use your account), your membership could be cancelled.

Entertainment Content
We distribute movie, television, and other filmed entertainment. Under no circumstances shall Elk River DVD Club or its shareholders, directors, officers, or employees be held liable for any loss or damage caused by your reliance on information obtained through the Elk River DVD Club. It is your responsibility to evaluate the information, opinion, advice, or other content available through the Elk River DVD Club.

Limitations on Use
You must be 18 years of age or older to join Elk River DVD Club. Unless otherwise specified, the movies obtained through Elk River DVD Club are for your personal and non-commercial use and we grant you a limited membership to Elk River DVD Club for that purpose. You may not allow anyone, other than those specified on the application, to use your membership to obtain privileges without our express written consent. Parental consent must be granted for a minor to receive a movie with an “R” rating. Any unauthorized use of the Elk River DVD Club or its movies will terminate the membership granted by us.


Right to Terminate
We reserve the right to terminate or restrict your use of our service, without notice, for any or no reason whatsoever.
